These Terms & Conditions (“Terms”) govern your access to and use of the website at aventuramobile.com and the mobile applications published by Aventura Mobile (“Aventura Mobile”, “we”, “us”, or “our”) — together, the “Services”. They apply to every Aventura Mobile app and to our website. Please read them carefully: by downloading, accessing, or using the Services, you agree to be bound by these Terms.
Acceptance and Eligibility
By accessing or using the Services, you confirm that you can form a binding contract with us, that you are old enough to do so under the laws of your jurisdiction and meet the Apple App Store age requirements, and that you accept these Terms and our Privacy Policy. If you are using the Services on behalf of an organisation, you represent that you have authority to bind it. If you do not agree, you must not use the Services.
The Services
Aventura Mobile designs and publishes mobile applications distributed primarily through the Apple App Store, along with this website. We may add, modify, suspend, or discontinue features — or entire Apps — at any time, and we are not liable to you or any third party for doing so.
Licence to Use
Subject to these Terms and the Apple App Store terms set out below, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable licence to download and use our Apps on any Apple-branded device that you own or control, and to use our website, for your personal, non-commercial purposes (unless we agree otherwise in writing). All rights not expressly granted to you are reserved by Aventura Mobile and its licensors.
Apple App Store Additional Terms
This section applies to any App you download from the Apple App Store and supplements the rest of these Terms. If there is any conflict, this section governs for App Store apps. You acknowledge and agree that:
- These Terms are concluded between you and Aventura Mobile only, and not with Apple. Apple is not responsible for the Apps or their content.
- Apple has no obligation whatsoever to provide any maintenance or support services for the Apps.
- If an App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for that App. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Apps, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are our responsibility.
- Apple is not responsible for addressing any claims by you or a third party relating to the Apps or your use of them, including product liability claims, claims that an App fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
- In the event of any third-party claim that an App or your possession and use of it infringes that party’s intellectual property rights, Aventura Mobile — not Apple — is solely responsible for the investigation, defence, settlement, and discharge of that claim.
- You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting”, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- You must comply with any applicable third-party terms of agreement when using the Apps, as well as the Apple Media Services Terms and the Usage Rules set out in Apple’s App Store Terms of Service.
- Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
Accounts and Registration
Certain features may require an account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account, and you agree to provide accurate, current information and to notify us promptly of any unauthorised use.
Purchases, Subscriptions, and Renewals
Some Apps offer paid features, one-time purchases, or auto-renewing subscriptions. All payments are processed by Apple through your App Store account and are subject to Apple’s terms. Auto-renewing subscriptions renew automatically for the same period unless you cancel at least 24 hours before the end of the current period, and your account will be charged for renewal within 24 hours before the period ends. You can manage or cancel subscriptions at any time in your App Store account settings. Except where required by law, payments are non-refundable, and refund requests are handled by Apple.
User Content
You retain ownership of the content you submit through the Services. By submitting content, you grant us a worldwide, royalty-free licence to host, use, reproduce, and display that content solely as needed to operate and improve the Services. You are responsible for your content and represent that you have the rights necessary to submit it. We may remove content that violates these Terms or applicable law.
Acceptable Use
You agree not to misuse the Services. Prohibited activities include, but are not limited to:
- Violating any applicable law or the rights of others.
- Attempting to gain unauthorised access to systems, accounts, or data.
- Interfering with or disrupting the integrity or performance of the Services.
- Reverse engineering, decompiling, or attempting to extract source code, except to the limited extent permitted by law.
- Uploading malicious code or misleading, harmful, or unlawful content.
Intellectual Property
The Services — including all content, design, logos, trademarks, and software — are owned by or licensed to Aventura Mobile and are protected by intellectual property laws. The “Aventura Mobile” name and logo are our marks and may not be used without our prior written permission. No rights are granted to you except as expressly set out in these Terms.
Third-Party Services
The Services may integrate with or link to third-party services, including the Apple App Store. Your use of those services is governed by their own terms and policies, and we are not responsible for them.
Disclaimers
The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Services will be uninterrupted, secure, or error-free.
Limitation of Liability
To the maximum extent permitted by law, Aventura Mobile shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of, or inability to use, the Services. To the extent liability cannot be excluded, our total aggregate liability is limited to the greater of the amount you paid us for the relevant App in the twelve months before the claim or USD 50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Aventura Mobile from any claims, damages, liabilities, and expenses arising out of your misuse of the Services, your violation of these Terms, or your infringement of any third-party right.
Termination
We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms or for any other lawful reason. You may stop using the Services at any time and delete the Apps from your devices. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — will survive.
Governing Law
These Terms are governed by the laws of the jurisdiction in which Aventura Mobile is established, without regard to its conflict-of-law principles. Nothing in these Terms removes any mandatory consumer protections available to you under the law of your country of residence.
Changes to These Terms
We may revise these Terms from time to time. When we do, we will update the “Last updated” date above. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
